WEBSITE TERMS OF SALE

These Terms of Sale apply to purchases made by consumers through the Sip Champagnes Ltd website at sipchampagnes.com.
If you are buying goods from us for business, trade or resale purposes, these terms do not apply. Trade orders are governed by our separate Trade Terms & Conditions.

2. These Terms
These Terms of Sale govern the sale of goods ordered by you through our website.
By placing an order on our website, you confirm that:
- you are legally capable of entering into a binding contract
- you are at least 18 years old
- you are purchasing as a consumer and not in the course of a business

3. Age-Restricted Products
We sell alcohol, so you must be 18 or over to place an order.
We reserve the right to carry out age verification checks before accepting an order and/or before delivery.
Orders containing alcohol must be accepted by a person aged 18 or over. Our delivery partners may ask for valid proof of age on delivery.
If suitable proof of age is not provided, or if no person aged 18 or over is available to accept delivery, we may refuse delivery and cancel the order. In those circumstances, we may deduct any direct costs reasonably incurred by us in connection with the failed delivery or return, where permitted by law.
4. Products, Vintages and Availability
All products are subject to availability.
Product descriptions, images, tasting notes, vintages, packaging and labels are provided for general guidance only. Because wine and Champagne are agricultural products, and producers may update packaging from time to time, the bottle, label, disgorgement, packaging or vintage supplied may differ from that shown on the website.
If a product is unavailable after you place an order, we will contact you. We will not substitute a different product without your consent. If we cannot fulfil your order, we will refund any amount paid for the unavailable item.
5. How the Contract is Formed
Placing an order through our website is an offer by you to purchase the goods.
After you place an order, you will receive an automated acknowledgement email. This does not mean that your order has been accepted.
A contract is formed only when we email you to confirm that your order has been accepted and/or dispatched.
We may decline an order at our discretion, including where:
- the goods are unavailable
- there is an error in pricing or product information
- age verification cannot be completed
- we reasonably suspect fraud, misuse or unauthorised activity
- delivery to your address is not possible
6. Prices, VAT and Delivery Charges
All prices shown on the website are in pounds sterling (£) and include VAT where applicable, unless otherwise stated.
Delivery charges, where applicable, will be shown during checkout before you place your order.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before acceptance of your order, we may cancel the order and refund any payment made.
7. Payment
Payment must be made in full at the time of order using the payment methods made available on the website.
We will charge your chosen payment method when you place your order.
If your payment is declined or reversed, we may cancel the order and/or suspend any further performance.
8. Delivery
Delivery times shown on the website or in any confirmation are estimates only.
We will deliver to the address provided by you during checkout.
You are responsible for ensuring that the delivery address is accurate and that someone aged 18 or over is available to accept delivery where the order contains alcohol.
If delivery is delayed by an event outside our reasonable control, we will take reasonable steps to notify you and perform the order as soon as reasonably possible.
Risk in the goods passes to you when the goods come into the physical possession of you, or a person identified by you to take possession of them.
9. Your Right to Cancel
If you are a consumer, you have the right to cancel your order within 14 days after the day on which you receive the goods.
To exercise your right to cancel, you must clearly tell us by email or in writing before the cancellation period ends.
If you cancel, you must send the goods back to us within 14 days of telling us that you wish to cancel.
Unless the goods are faulty, not as described or otherwise not in conformity with the contract, you are responsible for the cost of returning the goods.
We may reduce your refund to reflect any loss in value caused by handling the goods beyond what is necessary to establish their nature, characteristics and condition. For the avoidance of doubt, opening a bottle goes beyond what is necessary for inspection, and opened bottles are not returnable under the cancellation right unless faulty.
We will refund the price paid for the goods and the basic delivery charge (if any) within 14 days of receiving the goods back, or earlier if we receive satisfactory evidence that you have returned them.
10. Faulty, Damaged or Incorrect Goods
Nothing in these Terms affects your legal rights if goods are faulty, damaged, not as described, or otherwise not in conformity with the contract.
Please inspect your order on delivery and notify us as soon as reasonably possible if anything is missing, damaged, incorrect or faulty.
Where goods are faulty, damaged, incorrect or not as described, we will offer an appropriate remedy, which may include replacement, repair, refund or price reduction, depending on the circumstances and your legal rights.
We may ask for photographs, batch details, collection of the goods, or return of the goods before processing a remedy where reasonably necessary.
11. Returns Outside the Cancellation Right
Except where goods are faulty, damaged, incorrect or not as described, returns are accepted only at our discretion.
Any discretionary return authorised by us must be unopened, in original saleable condition, and returned in accordance with our instructions.
12. Limitation of Liability
We are responsible for losses you suffer that are a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, but we are not responsible for losses that are not foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- your statutory rights relating to goods
We supply goods for domestic and private use only. We are not liable for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity.
13. Events Outside Our Control
We are not responsible for delay or failure to perform caused by events outside our reasonable control, including transport disruption, severe weather, supply shortages, producer delays, strikes, customs issues or carrier failures.
If such an event continues for an extended period, we may cancel the affected order and refund sums paid for undelivered goods.
14. Intellectual Property
All content on the website, including text, images, branding, logos and product descriptions, belongs to us or our licensors and may not be copied or used without permission, except as permitted by law.
15. Data Protection
We process personal data in accordance with our Privacy Policy.
16. Governing Law and Disputes
These Terms are governed by English law.
If you are a consumer, you and we agree that the courts of England and Wales will have jurisdiction in relation to any dispute or claim arising out of or in connection with these Terms or your order.
However, nothing in these Terms affects any mandatory rights you may have under the law of the country in which you live, where those rights apply and cannot lawfully be excluded or limited.
If you live in Scotland, you may also bring proceedings in the Scottish courts.
If you live in Northern Ireland, you may also bring proceedings in the courts of Northern Ireland.
17. Changes to These Terms
We may update these Terms from time to time. The version in force at the time you place your order will apply to that order.
